Enhancing E-commerce Regulations.

The e-commerce industry in Togo is getting ready for a new regulatory framework that is more explicit and compliant with global norms. A new step was taken in Lomé on Thursday, February 20, when the findings of a series of consultations with stakeholders in the sector and talks on the creation of a preliminary draft law were presented. 

The initiatives undertaken by the Ministry of Commerce since 2021, aimed at supporting small and medium-sized enterprises (SMEs) and small industries (SMIs), are designed to address the challenges faced by a rapidly growing sector. These challenges include ensuring the reliability of online transactions, enhancing payment security, and safeguarding personal data. The anticipated regulatory framework, once implemented, is expected to provide clear guidelines that will protect the rights of online consumers, streamline transactions, and regulate the operations of e-commerce platforms, among other objectives.

Legal frameworks and regulations are being developed for e-retailers and commercial influencers.

Primarily, the new legal structure should consider and clearly define the roles associated with e-retailers and commercial influencers, which have gained significant popularity on major social media platforms like TikTok and Facebook in recent years. The goal is to enhance regulation within the sector and equip it with new tools and specific responsibilities.

E-commerce in Togo is experiencing significant growth, driven by improved internet access, with over 20% of the population now participating, a notable increase from just 6% in 2018. An independent consultant’s survey indicates a substantial rise in both national and international activities within the sector. Various promotional channels are being utilized, with online stores, social media, and marketplaces leading the way.

“Our aspiration is for Togo to establish a clear and appealing regulatory framework that addresses local needs and realities while also aligning with regional, continental, and international standards,” stated Koffi Vinyo Mensah, the chief of staff at the ministry.
